I understood it that Harry was the one who issued that as a condition. That Draco had to be sober for him to even think about sex, and then Draco brought that spell up. Lets face it insults are foreplay between these guys. And I would not deny being drunk even when I am just slightly so. But thank you for clarifying :) Lets see where you are taking this.
